Eviction Rules During COVID-19

The economic hardship brought on by the coronavirus is a pain that everyone is facing. Our Little Rock movers understand that the amount of uncertainty in the world right now is uncomfortable. Many people are displaced from jobs, wondering how they are going to make the next payment on their rent. Some states have put a coronavirus eviction ban in place to protect tenants who may be unable to pay their rent due to the layoffs and furloughs brought on by the pandemic. The ban gives tenants from April 6 up to to 90 days after the state of emergency is lifted to avoid any legal action or demands for rent. Once that period is over, however, normal eviction proceedings will resume.

Eviction Rules During COVID-19

Many states are beginning to lift shelter-in-place orders. Though there is no word on whether or not these states are still considered to be in a state of emergency, many people who rent their homes are getting nervous. Even though businesses are once again opening their doors to the public, this does not mean that employees who were laid off are getting their jobs back. Many businesses are only operating at half capacity or less, which calls for fewer staff. Without a means of income, there are millions of Americans who are still trying to figure out how to make ends meet.

Pay your rent if you can manage
If you can manage to pay your whole rent, it is best to go ahead and do so. Since the coronavirus eviction ban does not forgive rent payments, it is best to pay your rent either in full or as much of it as you can.

Your landlord can still file in court
Despite the eviction ban, this does not mean that your landlord cannot go to court and file for an eviction if they choose. The case will not go to trial until the 90 days after the state of emergency is lifted, but once it does, you will be expected to appear.

Check on your local city or county measures
Every state and even each city handles evictions differently. Your city or county may offer more protections, so be sure to do research on your local eviction suspensions.

You do not have to worry about a court summons
The Judicial Council has ruled that courts are not to issue summons, which is needed for your landlord to serve you.

There are no judgments taking place during COVID-19
If on the off chance you are summoned, you will not be penalized for failure to appear in court. If you have a preexisting eviction case, it will be delayed for 60 days.

You cannot be locked out of your home
The Metropolitan Housing Alliance announced that those who are in public housing or are a Section 8 tenant in Little Rock will not be evicted during the coronavirus pandemic.

Get a lawyer
If you receive a notice from your landlord about an eviction, the best defense is to speak with local legal aid on the matter.
